Paralegal since 2002, involved in general litigation cases, including complex personal injury and wrongful death, property damage, insurance coverage, and medical negligence. While much of my tort experience is on the plaintiffs' side, I have done a lot of defense work in contract and insurance coverage cases as well. I also have some experience in criminal litigation, including first-degree murder. My interests and abilities include reviewing and analyzing documents produced in discovery, reviewing and summarizing medical records, summarizing depositions, legal research, and assisting at trials in the New England area, Massachusetts especially. I draft and/or edit pleadings, including appellate briefs and discovery responses and prepare appellate appendices. Some representative cases I have been involved in: Dubuque v. Cumberland Farms, 93 Mass. App. Ct. 332 (2018). This was a wrongful death case against a convenience store chain alleging negligence for failure to protect its customers entering the store from out-of-control vehicles. The jury awarded the plaintiff over $32 million after three weeks of trial. I was the primary paralegal from inception through settlement, reviewing approximately 65,000 documents produced, summarizing approximately 20 depositions, assisting at trial, and participating in the drafting and revision process of all pre- and post-trial filings and appellate briefs. Complete Restoration Solutions v. Historic Round Hill Summit, Hampshire County, Massachusetts. After a large fire loss at a luxury apartment complex, a property owner engaged a remediation company at the suggestion of its insurer. The restoration company submitted its bill for over $600,000 for a month's worth of work. The insurance company later denied the claim, so the remediation company sued the property owner. I reviewed the bill and compared it with documents produced in discovery; the company has admitted to an overcharge of approximately $200,000. I summarized approximately ten depositions. The case is still pending, as of October 2022. Fowler v. Bally Total Fitness, Cook County, Illinois. This was the sixth case in which I was involved alleging a company's failure to equip its facilities with automated external defibrillators. These lawsuits taught me about the industry-growing nature of the common law. I summarized many depositions, reviewed the documents produced by the defendant, and assisted in the editing and final production of the plaintiff's opposition to a lengthy motion to dismiss. The court ultimately found a waiver applied to the plaintiff's negligence claim, but left the gross negligence claim intact. The case settled shortly before trial. Commonwealth of MA v. Fonseca, Hampden County, Massachusetts. Mr. Fonseca was charged with first-degree murder of a five-month-old infant. After awaiting trial in jail, for nearly five years, a jury acquitted him of all charges when a witness testified to another's participation in the terrible incident. My involvement in the case included review of medical and DCF records and trial support. The bulk of my work has been in Massachusetts, including the Appellate and Supreme Judicial Courts, and the US District Court for the District of Massachusetts. I have also been involved in isolated cases filed in California, Texas (federal), Illinois, and Florida. I have been working exclusively in the Ohio Court of Common Pleas since October, 2020.
