Greetings. I’m in the business of selling consumer products as a registered vendor with Groupon. I had a successful relationship with them until recently when they have decided, unjustifiably, to suddenly terminate my account.
For the period November 1, 2017 through November 14, 2017 I successfully received orders from consumers, completed them, and shipped the merchandise. There have never been any complaints by the ultimate consumers.
For some reason, Groupon has terminated my account and I am not sure entirely why. I had asked him repeatedly by email and did not get a satisfactory response. Nevertheless, I have decided it is best not to continue working with them.
But in the meantime, without my consent, they have canceled and refunded to all the consumers these completed orders. And Groupon is not paying me $18,304.57 for those completed orders.
My Groupon contract provides for binding arbitration. As you can see from the enclosed, I have sent them both a demand letter and a proposed Statement of Claim for arbitration through the American Arbitration Association. It has not yet been filed.
After I sent it, I received the following email:
I am a member of the Risk Management team in Groupon's Legal department. I would like to speak with you before you file for arbitration. I tried calling you at xxx-xxx-xxxx, but did not get through.
Is there a phone number where I can reach you? You can also reach me at xxx-xxx-xxxx.
I am seeking a licensed attorney, from any state, who can contact the legal department and negotiate for me to reach a settlement, hopefully without having to go through the arbitration. Based on their email, I believe they are serious and wanting to come up with a settlement.
