I am endeavoring to understand, precisely what would be needed to have a valid resignation letter written, but also, including a document/litigation preservation order, and a statement of rights.
My present employer has altered their position (relentlessly), as new, and challenging financial positions situations arise for them.)
They are insisting I be an independent contractor. This employment prospect has not, and is not the case. I need to proffer a resignation; with the preservation of my rights as an employee. Protect my intellectual properties (I filed a patent while working for this organization, in California), and designed, invented, innervated, and operationalized every bit of intellectual property for this group.
I am not an independent contractor. In 2 1/2 years, this is the only organization that directed my efforts, they have reimbursed expenses, prevented me from working elsewhere, and only insisted I be an independent contractor - when they were no longer able to pay me.
They are attempting to strip my percentage (5%), and take my intellectual properties to someone else. They have failed to pay me my full compensation, as well has never having paid payroll taxes, health insurance, or made any reasonable accommodations under the EEOC, or ADA (under which I am protected.)
They are now refusing to release my contracts to me. Moreover, are directing me towards an attorney. There is no money; they have no hope of prevailing in litigation. I aim to extricate myself while preserving my rights.
