Hello, We are looking for legal advise on a patent infringement case. Basically we are a small UK LTD and we sell our products on amazon and ebay. (US and UK) . We imported a product from China early this year and started selling it however several weeks later we received a cease and desist letter from a company who owns a design patent which is part of our product. We have investigated the claim and it seems to be legitimate. Obviously we had to stop selling the product for the time being. We still have over 500 units in stock and if we are able to sell these we may recover approx. 75% of our costs. (around 10-12k). We have not got much money in the company at the moment so we thought that we could risk to carry on selling our entire stock until it runs out. We believe that taking a legal action against us would cost them money than the amount they would be able to claim on us so they might let us to sell out . The question is, what is the worst case scenario in this case? We don’t want to destroy the products and loose the money we invested in.
