We are looking to manufacture a baby sleepsuit very similar to the Bonds "Wondersuit" made by Pacific Brands Pty Ltd (an Australian based company). There is a patent on the design in Australia - http://www.ipaustralia.com.au/applicant/pacific-brands-clothing-pty-ltd/patents/AU2012203871/ We want to know if the roll down cuff for the foot portion can be copied in the USA on any garment i.e. sleepsuits, baby leggings etc? Many brands in both Australia and the US (including GAP) already do the two-way zip and fold down mittens but we have not seen the roll down foot cuff anywhere. I have searched the USPTO and cannot seem to find any corresponding patents, however, we understand that US patent laws prevent the acquisition of patents on inventions that are already known or patented anywhere in the world.
