We are a small Property Management Company in California. I have a Real Estate Law question. I can only work with USA based lawyers on this since it deals with US Real Estate Law in Pennsylvania. I want to buy a piece of Raw Land from someone---about 1.9 acres. The land is owned clear in this persons name. Their is a mobile home on the land that I am just going to tear down and wreck. However---recently I learned that the owner inherited this mobile home--separate title---from her deceased parents. There is about 20k of debt on this mobile home. The home is on stilts about 10 feet in the air because it's by a river that floods every 10 years or so. She currently lives there but does not even want it---but again---it was inherited by her so the bank/finance company was trying to collect from her. At one point they told her to just pay 5k and she would own it. She did not have the money. She wanted to do a payment plan---they said no--and the amount is 20k again... Here is my question.... Basically if I buy this land---and if this mobile home which I certainly do NOT want is on the land under a separate title----what does that mean for me? Am I in anyway whatsoever responsible in any way for this mobile home. The way I see it is this mobile home---essentially a vehicle---would be illegally on my property after the sale...Would the owner not have to move it? I mean she would not be able to move it even if she wanted to. So what does this all mean for me? Again---I do NOT want this mobile home. I want it gone. But I do not want any surprises down the road. Thanks so much... Chris

We are looking for a licensed attorney in the state of Georgia that is able to research lending and real estate laws related to business purpose lending and write a letter of opinion similar to the one attached. We are looking to enter the Georgia market as a hard money lender for business purpose loans but we need to understand the requirements about commercial loans. In Florida, as long as we are originating hard money loans for business professionals we do not need an NMLS license and we are able to operate with our real estate license just as we are also able to do so in California with our real estate brokerage license.
