Trademark likelihood of confusion opinion, iOS app name vs pending mark

I need a written likelihood of confusion opinion from a licensed US attorney on a proposed name for a free iOS app, before I submit it to the App Store. The app is a private availability signal for a small group of close contacts. No feed, no public profiles, no in-app messaging. Class 9 would be roughly: downloadable software for signalling availability to a small private group of contacts. There's one pending intent-to-use application I've found that concerns me, with overlapping goods in class 9. I'll share the name and serial number once we're working together. What I need: whether use of my proposed name would likely be refused registration over that mark, how likely a challenge from its owner would be if I launch without registering, what my exposure is as the junior user, and whether you'd recommend proceeding.
