Business Immigration Attorney – H-1B Sponsorship

Overview We are a technology company seeking an experienced business immigration attorney to advise and represent our company regarding H-1B sponsorship for a technical employee. We are looking for an attorney (preferably in Virginia but other states will be accepted) who can provide strategic employer-side guidance and manage the H-1B process from initial planning through petition preparation, filing, and approval. Scope of Work The attorney will be expected to: * Evaluate H-1B sponsorship strategy and eligibility. * Review and advise on the proposed technical position and specialty occupation requirements. * Determine the appropriate occupational classification and prevailing wage requirements. * Advise on appropriate wage level and compensation structure. * Advise on full-time and part-time H-1B employment options. * Advise on hourly versus salaried compensation. * Prepare and manage the Labor Condition Application (LCA). * Provide guidance regarding required employer notices and Public Access File requirements. * Prepare and submit H-1B registration, when applicable. * Prepare and file Form I-129 and supporting documentation. * Advise on applicable USCIS fees and employer obligations. * Respond to Requests for Evidence (RFEs), if necessary. * Advise regarding premium processing. * Provide ongoing employer H-1B compliance guidance. Qualifications We are specifically seeking an attorney with: * Active U.S. law license in good standing. * Strong business/employment immigration experience. * Significant experience with employer-sponsored H-1B petitions. * Experience representing technology companies and technical professionals. * Experience with prevailing-wage and wage-level analysis. * Experience with part-time H-1B employment arrangements. * Experience preparing LCAs and H-1B petitions. * Experience responding to H-1B RFEs. * Experience advising small and midsize employers. AILA membership is preferred.
