California Attorney Needed – CIPA / ADA Website Lawsuit Defense We are a small California retail and e-commerce business seeking a California-licensed attorney to advise, file a response, and potentially represent us in a recently filed lawsuit in Contra Costa County Superior Court. The lawsuit involves website-related claims under: California Invasion of Privacy Act (CIPA, including Penal Code § 638.51) California Computer Data Access and Fraud Act / Penal Code § 502 Unruh Civil Rights Act / ADA website accessibility California Unfair Competition Law The privacy allegations involve common website technologies including Google Analytics, Meta/Facebook tracking, Shopify Analytics, and Shopify applications. The accessibility allegations involve use of the website by a visually impaired individual using screen-reading software. The plaintiff is represented by Manning Law, APC. We are looking for an attorney who has experience defending California businesses against CIPA website tracking/pixel claims and/or ADA/Unruh website accessibility lawsuits. Experience dealing with Manning Law or similar high-volume plaintiff firms is highly preferred. What We Need: Initially, we would like an attorney to: Review the complaint and assess our defenses Evaluate the CIPA § 638.51 and Penal Code § 502 claims Evaluate the ADA/Unruh accessibility claims Recommend whether an early pleading/motion, settlement, or other strategy makes the most economic sense Advise regarding preservation and remediation of website tracking/accessibility issues Potentially represent the company in the Superior Court action We are looking for a practical and cost-conscious defense strategy. We are particularly interested in attorneys who offer reasonable hourly rates, flat-fee stages, or capped-fee arrangements. Preferred Qualifications: Active California Bar license California civil litigation experience CIPA/privacy litigation experience, particularly § 638.51 website tracker/pixel cases ADA/Unruh website accessibility defense experience Familiarity with Google Analytics, Meta Pixel and Shopify-related claims Experience with Manning Law, APC or similar plaintiff firms is a major plus Please include in your response: Your California Bar number Your experience with CIPA § 638.51 website-tracking litigation Your experience defending ADA/Unruh website cases Whether you have handled matters involving Manning Law and/or Jesus Torres Your hourly rate and/or available flat-fee or capped-fee arrangements Whether you are available to represent a defendant in Contra Costa County Superior Court
