Copyright Attorney — Image Licensing & Rights Negotiation

About the Role We are seeking a copyright attorney to lead the resolution of a matter involving an image currently in use without a valid license. The immediate priority is to assess the situation, establish a fair valuation, and negotiate terms that protect our interests — whether that means securing a retroactive license, a forward-looking usage agreement, or a settlement. Key Responsibilities Evaluate the unlicensed use of the image and analyze the associated rights, exposure, and leverage on both sides. Determine a defensible fair-market value for the use, drawing on comparable licensing rates and applicable damages frameworks. Lead direct negotiations with the counterparty (rights holder or user, as applicable) to reach a license or settlement on favorable terms. Draft and finalize the resulting licensing agreement, settlement, or release, including scope, territory, duration, and indemnification provisions. Advise on strategy and fallback options, including cease-and-desist letters, DMCA procedures, and litigation risk, and use these appropriately as negotiating leverage. Communicate clearly with internal stakeholders, translating legal risk into plain-language recommendations. Required Qualifications J.D. and active bar membership in good standing (jurisdiction: California). Demonstrated experience in copyright law, with a focus on image or visual-media licensing. A track record of negotiating and closing licensing agreements or infringement settlements. Strong drafting skills and command of copyright fundamentals (ownership, fair use, registration, statutory vs. actual damages).
