Summary

The Law Office of Jerry J. Kaufman is seeking a meticulous, highly experienced remote U.S. Immigration Attorney to manage end-to-end casework, brief drafting, filings, and hearing appearances with minimal supervision. Scope of Work & Responsibilities: • Immigration Court (EOIR) Appearances: Represent clients in EOIR Master Calendar and Individual hearings (primarily remote via Webex, or in-person if required/local). Prepare respondents and handle direct/cross-examination and oral arguments. • Post-Conviction Relief (PCR) & Crimmigration: Analyze criminal records and convictions for immigration consequences (CIMT, aggravated felonies, controlled substance violations). Draft substantive motions for post-conviction relief/vacaturs based on legal and constitutional invalidity (e.g., ineffective assistance of counsel / failure to advise under Padilla) and prepare waiver packages (INA § 212(h), § 212(c), EOIR cancellation of removal). • Humanitarian & Family Filings: Handle affirmative and defensive Asylum cases, USCIS Asylum Office interviews, immediate relative petitions (I-130, I-485), and consular processing. • INA Section 245(i) Adjustments: Independently evaluate grandfathering eligibility (pre-April 30, 2001 filings), compile requisite physical presence proof, and prepare complete Form I-485 Supplement A packages. • Business & Employment Petitions: Draft and assemble EB-2 (National Interest Waiver / NIW), EB-3, and L-1 (intracompany transferee) filings. • Complex Responses: Draft comprehensive, persuasive legal briefs, exhibit indexes, and robust responses to Requests for Evidence (RFEs), Notices of Intent to Deny (NOIDs), and EOIR motions. Qualifications & Requirements: • Active State Bar license in good standing (any U.S. jurisdiction; EOIR e-registration in good standing). • Prior experience appearing before EOIR Immigration Judges (via Webex / remote hearing platforms) and representing clients at USCIS interviews. • Demonstrated hands-on experience handling Post-Conviction Relief (PCR) analysis for immigration, business petitions (EB-2 NIW, EB-3, L-1), asylum, and INA § 245(i) adjustments. • Exceptional attention to detail in legal drafting, statutory analysis, and court submissions. • Strong self-direction—proven ability to manage casework independently, meet strict court/agency deadlines, and produce submission-ready filings. • Willingness to execute an NDA and complete a standard client conflict check prior to starting.
