Targeted Design Patent Clearance vs. 1 Named Competitor Eyewear Frame (Flat Fee, US Patent Attorney)

Summary

I'm an independent eyewear brand preparing a first production run of an acetate sunglass frame. The frame's design was informed by a specific existing frame from one established European eyewear brand. Before I place the production order, I need a US-registered patent attorney to assess infringement risk against that one competitor only. Scope (fixed, no landscape search): Targeted clearance: Identify all live US design patents held by the named competitor (and its named designers/assignees). Compare each against my finalized technical drawing (full dimensional spec, front/side/top views, provided on hire). Opine on infringement risk for each relevant patent. Trade dress risk assessment: My frame will be produced in a color/finish similar to one of the competitor's known colorways. Assess trade dress risk for this single colorway choice against this single competitor. Deliverable: A written memo (not a formal opinion letter) stating your analysis, risk level, and any recommended design modifications. Plain-English summary plus your legal reasoning. What this is NOT: This is not a patentability search, not a filing, and not a comprehensive FTO landscape search across the eyewear field. Clearance against one named competitor's portfolio only. Please do not bid if you intend to deliver a patentability report. You provide on day one of hire: I will send the technical drawing (PDF), the competitor's product photos and published specs, and a written summary of the dimensional departures between my frame and the reference. Requirements: US-registered patent attorney (USPTO registration number required in your proposal) Flat fee only; state your fee and turnaround in your proposal Competitor name disclosed only to the hired attorney Budget: $800 fixed. Timeline: 7-10 business days from receipt of materials.
