I am looking to retain Texas counsel to represent me in a civil case pending in Montgomery County, Texas, Jonathan Hayes and Debbie Beaty v. Black Gold Texas Tea Oil, LLC, Tony Serna, et al., Cause No. 26-02-02645. The dispute involves money that Hayes and Beaty provided to Black Gold Texas Tea Oil. My position is that this was a business transaction involving the company, not a scheme to defraud them, and that the funds were used in connection with the company's operations. Black Gold had other revenue as well, and company funds were commingled in the company's operating account. There are several factual issues that I believe are important to the defense, including what representations were actually made before the transaction, the parties' understanding regarding repayment and timing, production and operational delays experienced by Black Gold, communications keeping them informed about those delays, and the fact that I do not recall receiving a formal demand for repayment before the lawsuit. The plaintiffs are also pursuing claims against members of my family, and I want counsel to evaluate whether there are proper grounds for those individuals to remain defendants and whether the plaintiffs can actually establish individual liability rather than merely a claim against the company. I am currently incarcerated in federal custody at Forrest City, Arkansas, which makes it difficult for me to personally handle discovery, hearings, document production, and communications with opposing counsel. I therefore need an attorney who can take over or substantially assist with the litigation. Plaintiffs' counsel has granted me a 14-day extension for my current response. I have been working through the allegations and discovery issues and am also obtaining the relevant Black Gold bank statements. I can provide the petition, answers/pleadings, correspondence with plaintiffs' counsel, discovery requests, contracts or agreements, bank records, and the other documents needed for counsel to evaluate the case. I would like you to evaluate the case, the claims against me and the other defendants, available affirmative defenses and procedural defenses, discovery strategy, and whether there are grounds for dismissal or summary judgment as the evidence develops.
