𝗣𝗛𝗔𝗦𝗘 𝟭 — 𝗜𝗠𝗠𝗘𝗗𝗜𝗔𝗧𝗘 𝗧𝗥𝗔𝗗𝗘𝗠𝗔𝗥𝗞 𝗣𝗥𝗢𝗧𝗘𝗖𝗧𝗜𝗢𝗡 The immediate scope includes: ✓ Verify a third-party notification concerning a potentially competing trademark application. ✓ Search USPTO records and identify the applicant, filing status, classes, deadlines, and level of risk. ✓ Determine whether immediate action is required, including a 𝗟𝗲𝘁𝘁𝗲𝗿 𝗼𝗳 𝗣𝗿𝗼𝘁𝗲𝘀𝘁, extension, 𝗡𝗼𝘁𝗶𝗰𝗲 𝗼𝗳 𝗢𝗽𝗽𝗼𝘀𝗶𝘁𝗶𝗼𝗻, formal response, or another protective measure. ✓ Review and prepare the renewal of an active federal trademark registration currently within its regular 𝗦𝗲𝗰𝘁𝗶𝗼𝗻𝘀 𝟴 𝗮𝗻𝗱 𝟵 filing window. ✓ Assess eligibility for a 𝗦𝗲𝗰𝘁𝗶𝗼𝗻 𝟭𝟱 𝗗𝗲𝗰𝗹𝗮𝗿𝗮𝘁𝗶𝗼𝗻 𝗼𝗳 𝗜𝗻𝗰𝗼𝗻𝘁𝗲𝘀𝘁𝗮𝗯𝗶𝗹𝗶𝘁𝘆. ✓ Evaluate whether a canceled logo registration should be refiled. ✓ Advise on new 𝗖𝗹𝗮𝘀𝘀 𝟵 protection for a mobile application and the appropriate word-mark, house-brand, or composite strategy. 𝗣𝗛𝗔𝗦𝗘 𝟮 — 𝗖𝗢𝗥𝗣𝗢𝗥𝗔𝗧𝗘 & 𝗜𝗣 𝗦𝗧𝗥𝗨𝗖𝗧𝗨𝗥𝗘 We also need counsel to evaluate the relationship between: • A 𝗗𝗲𝗹𝗮𝘄𝗮𝗿𝗲 𝗰𝗼𝗿𝗽𝗼𝗿𝗮𝘁𝗶𝗼𝗻 intended to operate as the broader parent/umbrella company. • A 𝗩𝗶𝗿𝗴𝗶𝗻𝗶𝗮 𝗟𝗟𝗖 that currently owns several federal trademark registrations. • Multiple operating brands, digital products, domains, and a mobile application. Counsel should recommend whether the current structure should be maintained, reorganized, or supplemented through: → Trademark and IP assignments → Intercompany licensing → An IP-holding structure → Parent/subsidiary restructuring → Another legally and commercially appropriate model Experience coordinating 𝗰𝗼𝗿𝗽𝗼𝗿𝗮𝘁𝗲, 𝘁𝗿𝗮𝗱𝗲𝗺𝗮𝗿𝗸, 𝘁𝗮𝘅, 𝗮𝗻𝗱 𝗶𝗻𝘃𝗲𝘀𝘁𝗼𝗿-𝗿𝗲𝗮𝗱𝗶𝗻𝗲𝘀𝘀 considerations is strongly preferred. 𝗥𝗘𝗤𝗨𝗜𝗥𝗘𝗗 𝗤𝗨𝗔𝗟𝗜𝗙𝗜𝗖𝗔𝗧𝗜𝗢𝗡𝗦 ✓ Attorney licensed and in good standing in at least one U.S. jurisdiction. ✓ Substantial federal trademark prosecution experience. ✓ Direct experience with 𝗨𝗦𝗣𝗧𝗢 maintenance filings and 𝗧𝗧𝗔𝗕 matters. ✓ Ability to assess potential infringement and competing-application risks under tight deadlines. ✓ Experience advising startups, multi-brand organizations, Delaware corporations, LLCs, and IP ownership/licensing structures. ✓ Immediate availability to begin the initial assessment.
