I need help responding to a nonfinal Office Action on my trademark application. Mark is ASTRO BUDDIES, Serial No. 99768717, International Class 018 (pet accessories). Issue date August 24, 2026. Response deadline is November 24, 2026. I am open to two kinds of help. Tell me in your proposal which one you are offering. Track A: Licensed US trademark attorney. You advise, draft, sign, and file the response as attorney of record. Track B: Filing service or trademark paralegal. You prepare the response documents and declaration language. I sign and file it myself pro se. You do not appear as my representative and you are not giving legal advice. The three issues in the Office Action Section 1 and 45 refusal, premature use. The specimen showed "coming soon," so the examiner says the mark was not in use in commerce as of the filing date. Section 1 and 45 refusal, specimen insufficient. The website submitted was treated as mere advertising rather than a point of sale display. Clarification of legal entity required. The application names an individual as owner but lists the entity type as an LLC. Scope of work Review the Office Action and application file. Recommend one path: amend to Section 1(b) intent to use, or submit a substitute specimen with a verified declaration. I want a clear recommendation, not a list of options. Handle the entity clarification carefully. I understand a wrong answer here can void the application as filed. Prepare the complete TEAS response with correct declaration wording under 37 CFR 2.20. Track A: file it. Track B: give me exact step by step filing instructions and review my draft before I submit. Tell me what fees are triggered later if we amend the basis. Requirements Track A: Attorney licensed and in good standing in a US state. Include bar number and state. Active USPTO trademark prosecution experience. Track B: Demonstrated experience preparing Office Action responses, specifically specimen refusals. Be upfront that you are not providing legal representation. Do not apply as a "trademark agent," that is not a US credential and you cannot sign or file for me.
