USMCA/CUSMA Rules of Origin Assessment for Canadian D2C ECommerce Shipments to US Customers

Summary

We are a Canadian startup (Kelowna, BC) manufacturing an electromechanical consumer device and preparing to launch direct-to-consumer sales into the US market via Shopify. We ship via commercial courier (UPS/FedEx/DHL). Given the elimination of US de minimis exemptions, every unit we ship to a US customer is now a dutiable import, making USMCA/CUSMA origin qualification our primary cost protection mechanism. We need a focused, written assessment covering the following: USMCA/CUSMA rules of origin determination — does our product qualify as Canadian origin based on our bill of materials, under the applicable tariff shift or RVC test for our HS code? Sourcing recommendations — if we do not currently qualify, which components are the problem and what sourcing changes would achieve compliance? We have flexibility to adjust sourcing. HS code confirmation — we need the correct 10-digit HTSUS classification for our product confirmed before any duty analysis can be run. Current duty exposure — if USMCA qualification is not achieved, what is our per-unit duty liability under the current tariff environment, including MFN base rate and any applicable Section 232 tariffs on Canadian goods? D2C shipment documentation — what documentation must accompany each commercial courier shipment to properly claim CUSMA preferential treatment at the US border, and what does our Shopify/fulfillment workflow need to produce for each order? We have a complete bill of materials with component details available. The device is battery-powered, electromechanical, manufactured via 3D printing in BC. No wireless components. This is a bounded engagement with a specific deliverable — a written assessment and clear recommendations. Not a retainer. Fixed price preferred.
