Job Description Overview: I am seeking an active, legally registered USPTO Patent Agent or Attorney with proven experience to assist with reviewing and electronically filing SEVEN (7) separate US provisional patent applications. Current Status: All seven drafts are 100% prepared (including specifications, abstracts, detailed descriptions, drawings, and initial claims). No drafting is requested. Applicant profile (relevant to the forms, not to the technology): The applicant is a non-US corporate entity; the inventor is an individual, also non-US domiciled. An assignment from the inventor to the applicant is already executed and recorded with the USPTO. Foreign-domiciled applicant rules therefore apply throughout. SCOPE OF WORK: PROVISIONAL PATENT APPLICATION FILING 1. COMPLIANCE REVIEW SCOPE — Review is strictly limited to USPTO formalities, administrative completeness, and filing compliance. Claim refinement, technical drafting, drawing reformatting, and substantive revisions to the specification are outside this engagement. No substantive patentability or legal opinion work is requested or provided. 2. DISCRETE, LIMITED ENGAGEMENT — This is a one-time administrative e-filing engagement, not ongoing representation: - The scope concludes immediately upon delivery of the official USPTO Electronic Filing Receipts for all seven applications to the client. - Practitioner will file strictly in a representative capacity under 37 CFR 1.34; no formal Power of Attorney will be filed or maintained beyond this initial submission. - Any subsequent non-provisional applications, utility conversions, PCT filings, or ongoing USPTO matters require a new, separate engagement. 3. PRE-EXAMINATION FORMALITIES & NOTICES — Any Notice to File Missing Parts, Notice of Incomplete Application, or pre-examination corrections arising after the filing receipt date are excluded from this engagement and will require a new and separate agreement. 4. CUSTOMER NUMBER & CORRESPONDENCE — Practitioner will use their USPTO Customer Number and correspondence address solely for the initial e-filing transmission to ensure immediate electronic access and receipt generation. While Practitioner is not responsible for long-term docketing after filing receipts are delivered, Practitioner will, as a professional courtesy, promptly forward any USPTO notices received by Practitioner regarding these filings directly to the client. As noted in item 3, responding to such notices is not part of this agreement and will require a separate agreement. 5. ENTITY STATUS DETERMINATION — Entity status is not assumed. Because the applicant is foreign-domiciled and is a corporate entity, I am asking the practitioner to determine and certify the correct status rather than to accept an instruction: - A foreign-domiciled applicant cannot self-certify micro entity status; the certification must be signed by a registered practitioner. - Where the applicant is an entity, the gross-income limit applies to the applicant as well as to the inventor. Client will provide the entity-size and gross-income facts in writing and assumes full responsibility for their factual accuracy. Please state in your response which status you are prepared to certify and sign for. If small entity is the safer determination, I would prefer to file small entity and establish micro at conversion, where the discount is material. 6. DOCUMENT PREPARATION — Prepare required official USPTO administrative forms only (Application Data Sheet [ADS], entity certification where applicable, and Transmittal Cover Sheet) for each of the seven applications. 7. E-FILING & GOVERNMENT FEE HANDLING — Complete submission online via USPTO Patent Center using Practitioner credentials. Official USPTO fees under 37 CFR 1.16(d) for seven provisional applications: Micro entity: $65 per application = $455 for seven Small entity: $130 per application = $910 for seven Practitioner may advance the official government fees at the time of filing, subject to immediate reimbursement upon delivery of filing receipts. If you would prefer not to advance that sum, say so in your response — I am equally willing to fund the fees to you before filing. This is not a screening criterion. 8. KNOWN FORMALITIES, ALREADY ACCEPTED — So that nothing is a surprise at review, and so it is not quoted for twice: - Drawings are informal. Character height falls below 37 CFR 1.84(p)(3) on the sheets. Provisional drawings are not examined for 1.84 compliance; these will be filed as-is and formal drawings commissioned at conversion. No drawing work is requested. - Some applications carry more than thirty claims. This is irrelevant to a provisional and will be reduced before any Track One request. - Claims are included although a provisional does not require them. Requirements - Must be an Active & Legally Registered USPTO Patent Agent or Attorney (foreign-domiciled applicant rules apply). - Proven Recent Experience: must have active experience filing patent applications via the USPTO Patent Center. - Experience filing where the applicant is an entity rather than the inventor, and comfort signing an entity certification for a foreign-domiciled applicant. - Willingness to sign a standard Non-Disclosure Agreement (NDA) before reviewing full drafts.
