Commercial Real Estate & Creditor Rights Attorney (UCC, Loan Enforcement)

We are seeking an experienced attorney to assist with the enforcement and recovery of a private loan made in connection with a multifamily real estate investment. The matter involves a matured loan, potential security interest and lien rights, questions regarding UCC perfection and priority, and potential claims against proceeds from the sale of a multifamily property. We are looking for counsel who can quickly assess our position, advise on available remedies, and execute the appropriate legal strategy. Scope of Work Responsibilities may include: Reviewing loan documents, promissory notes, and related agreements Analyzing security interest and lien rights under the loan documents Determining whether a valid security interest exists and whether it was properly perfected Evaluating UCC Article 9 issues, including perfection and priority Conducting UCC, lien, and debtor searches Advising on filing UCC financing statements where appropriate Assessing claims to proceeds from the sale of real estate investments Evaluating remedies against borrowers, guarantors, and related entities Drafting and sending demand letters Advising on collection, enforcement, and litigation strategy Coordinating with title companies, closing attorneys, or transaction counsel if necessary Pursuing recovery through negotiation, litigation, or other available remedies Matter Overview Private loan made to a real estate investment sponsor/entity Loan has matured and appears to be in default Loan documents contain language granting lien rights upon default No confirmed UCC perfection currently exists Underlying investment is a multifamily property in Tennessee Property may be in the process of being sold, requiring an expedited review of creditor rights and potential claims against proceeds Ideal Candidate Licensed attorney in Tennessee or substantial experience handling Tennessee matters Strong background in creditor rights and secured transactions Deep understanding of UCC Article 9 Experience enforcing promissory notes and security agreements Familiarity with commercial real estate investments and syndications Experience with lien priority disputes and recovery actions Comfortable providing both strategic legal advice and hands-on execution Able to move quickly on time-sensitive matters To Apply Please provide: A brief description of similar matters you have handled Experience with UCC perfection, lien enforcement, and creditor rights Experience involving commercial real estate or multifamily investments Whether you are licensed in Tennessee Your availability for an initial review and consultation
