U.S. Copyright & Trademark Attorney for Publishing Company D. Craig Consulting LLC is seeking an experienced U.S.-licensed intellectual property attorney to handle copyright registrations, trademark clearance and filing, and publishing-related intellectual property matters. We operate an independent publishing and consulting business with one nonfiction business/biotech book currently published, two companion volumes in production, and additional titles in development. Immediate Priority Our first priority is copyright registration of an already-published nonfiction book. We are seeking counsel who can review the publication dates immediately, determine the appropriate registration strategy, and move quickly with the U.S. Copyright Office. Scope of Work The broader engagement includes: Copyright Register published and forthcoming nonfiction books Determine appropriate treatment of paperback, hardcover, and ebook editions Advise on copyright protection for companion spreadsheets and downloadable tools Review copyright ownership and assignments Advise on website and newsletter content protection Maintain copyright registration records and deadlines Trademark Conduct clearance searches for publishing, series, and company/imprint marks Provide written trademark risk assessments Advise on registrability of a nonfiction book series title Prepare and file USPTO trademark applications Recommend appropriate International Classes and filing bases Handle Office Actions and prosecution through registration Advise on international trademark protection where appropriate Publishing and Design Rights Review rights associated with an existing Amazon KDP-created book cover Determine whether the cover may legally be used through IngramSpark and other distribution channels Recommend remediation if necessary Review designer, editor, formatter, and contributor agreements Ensure copyright ownership and chain of title are properly documented An optional additional workstream involves reviewing the published manuscript for third-party copyright and related rights exposure. Attorney Qualifications Applicants should have: Active U.S. attorney license in good standing Significant experience registering literary works with the U.S. Copyright Office Direct experience prosecuting trademarks before the USPTO Experience with book titles, series trademarks, publishing imprints, or author brands Familiarity with Amazon KDP, IngramSpark, self-publishing, and print-on-demand publishing Experience reviewing copyright ownership and work-for-hire/assignment issues Professional malpractice insurance Experience representing independent publishers, authors, or small publishing imprints is strongly preferred. Fee Structure We prefer flat-fee pricing by phase or deliverable rather than open-ended hourly billing. Government filing fees should be quoted separately. Please Include in Your Proposal Please provide: Your name, firm, state of admission, and bar number. Your copyright and trademark experience during the past three years. Brief examples of publishing or author-side matters you have handled. Your experience registering book-series names or addressing the USPTO's "single creative work" trademark issue. Your proposed flat-fee structure. How quickly you can assess and begin the first copyright filing. Who will personally perform the work versus work delegated to others. Please do not apply if you are primarily a trademark filing service or non-attorney consultant. We are seeking experienced counsel who can provide substantive legal analysis and recommendations, not simply prepare forms.
