Fitness Company Client Contract Review & Refund Consultation

We are an online fitness coaching company that provides virtual coaching services to clients throughout the United States. We offer both six-month and twelve-month coaching programs and onboard approximately 600 new clients each year. We are seeking an attorney or experienced contract professional to review our client agreement and provide guidance regarding potential liability exposure, risk management, and contract enforcement. One specific issue we encounter is that once or twice per year, a client will purchase and pay in full for a six- or twelve-month coaching program, make little or no effort to participate in the program for several months, and then contact us demanding a refund. In some cases, these clients threaten legal action, chargebacks, or complaints despite having agreed to our cancellation and refund policies. We would like guidance regarding our exposure in these situations and recommendations on how to best handle them moving forward. Specifically, we are looking for assistance with the following: * Reviewing our current client agreement and terms of service * Evaluating our cancellation, refund, and chargeback provisions * Assessing our legal exposure when clients fail to participate in services but later demand refunds * Providing practical recommendations for responding to refund demands and legal threats * Identifying weaknesses or gaps in our current agreement * Recommending improvements to strengthen our agreement and better protect the company * Identifying any additional liabilities related to the services and deliverables outlined in our coaching programs * Advising on best practices for documenting client engagement and service delivery We are not currently facing active litigation. Rather, we are looking for proactive legal guidance to ensure our agreements, policies, and procedures are structured appropriately as we continue to grow.
