U.S. Gaming and Sweepstakes Attorney Needed for Free Sports-Prediction App

We are developing a confidential, free-to-play sports-prediction mobile application and seek an attorney or law firm experienced in gaming law, skill competitions, promotional contests, sweepstakes, and international digital products. The product name and other confidential details will be disclosed only after conflict checking and execution of an appropriate confidentiality agreement. Product overview Users do not pay to enter competitions or submit predictions. Users predict outcomes of real-world sporting events. Predetermined rules award scoring points based on prediction accuracy. Users do not stake or risk money, points, or anything else of value. Points are intended to function only as scores and rankings. Points cannot be purchased, transferred, sold, wagered, or exchanged. We are evaluating sponsor-funded gift cards, merchandise, recognition, and other potential rewards. An optional subscription may remove advertisements but will not provide additional entries, predictions, points, boosts, improved odds, scoring advantages, or preferential prize treatment. We intend to make the application available internationally. Requested work We need a written legal and regulatory analysis addressing: Whether the application constitutes gambling, sports wagering, a lottery, a sweepstakes, a prize competition, or a skill contest; Whether free entry removes the consideration or wagering element; How sports-prediction competitions based on multiple real-world events are classified; Whether advertising, subscriptions, scoring points, gift cards, merchandise, or other rewards create consideration or things of value; Whether points should remain nontransferable and nonredeemable; Which jurisdictions permit, regulate, or prohibit the proposed model; Licensing, registration, bonding, disclosure, age, tax, reporting, and winner-verification requirements; Recommended product restrictions, geolocation controls, and compliance procedures; Whether one annual competition with monthly or quarterly prize periods is viable; Drafting or reviewing Official Rules, Terms of Use, and required promotional disclosures; App-store, advertising-platform, and payment-provider considerations; and Whether technical skill, fairness, or game-mechanics certification would be useful. Geographic scope Please propose a phased jurisdictional review rather than assuming that one general conclusion applies worldwide. The proposal should identify: Jurisdictions the attorney can analyze directly; Jurisdictions requiring local counsel; The attorney’s ability to coordinate and supervise local counsel; Recommended first-wave launch countries; High-risk countries that should initially be geoblocked; and Separate pricing for the United States, Canada, United Kingdom, European Union member countries, Turkey, Australia, and other recommended markets. Deliverables Written legal memorandum applying relevant law to the actual mechanics; Country-by-country and, where necessary, state/province-level compliance matrix; Green, conditional, and prohibited jurisdiction classifications; Product and reward-structure recommendations; List of prohibited or high-risk features; Geoblocking and age-control recommendations; Draft or reviewed Official Rules and relevant Terms of Use provisions; Identification of required licenses, filings, bonds, local representatives, and tax obligations; Follow-up consultation; and Availability to answer reasonable questions from app stores, banks, advertisers, investors, or promotion administrators. Required qualifications Active and verifiable license to practice law in at least one relevant jurisdiction; Meaningful experience with gaming, sports predictions, skill contests, sweepstakes, prize promotions, or similar applications; Experience coordinating multijurisdictional reviews and local counsel; Experience preparing written opinions for mobile or online products; Ability to provide services through a formal attorney-client engagement, subject to conflict checking and confidentiality. Please include Bar or professional-registration numbers and jurisdictions of admission; Relevant gaming and promotional-law experience; An anonymized description of comparable international work; Countries your firm can cover directly; Proposed local-counsel approach; Whether professional-liability insurance is maintained; Proposed phases, fixed fees, milestones, and turnaround times; Exact jurisdictions included in each price; Whether Official Rules and Terms review are included; Whether third-party local-counsel fees are included; Whether the written work may be shared with app stores, banks, advertisers, investors, and promotion administrators; and Any information required to prepare an accurate proposal.
