Summary

I'm building a creative product brand and need help understanding the full IP strategy for a new consumer product line. I'm looking for high-level strategic guidance across copyright, patents, trademarks, trade secrets, and freedom-to-operate, and how to prioritize what actually matters for a physical and creative product business. PRODUCT OVERVIEW The core product is a creative system built around a flexible transparent silicone base plate. Printed artwork is placed underneath the base, and users place small removable tiles on top to create designs, similar to a paint-by-number or guided mosaic system. In addition, the business includes original artwork collections that extend across multiple creative mediums including colored pencils, markers, paint, and sticker-based art systems. The goal is to build a collectible creative ecosystem where designs and collections exist across multiple formats and product types. The brand name is already trademarked and published. WHAT I NEED HELP WITH -What should be protected through copyright registration, especially artwork and collections -Whether any part of the physical system is worth pursuing for design patent or utility patent protection -Whether there are any freedom-to-operate risks with existing patents or products -Whether any part of the system should be treated as trade secrets instead of public IP filings -What is actually worth prioritizing versus what is not worth spending money on I am looking for practical, business-minded guidance. WHAT I’M LOOKING FOR IN TERMS OF ENGAGEMENT -Initial IP strategy review, written or call based -Clear recommendations on what to pursue and what to ignore -Optional ongoing support as the product line expands BUDGET Please include your typical cost range for an initial IP strategy review and how you would scope an engagement like this.
