About Us: Promed Express is a next-generation technology platform connecting non-emergency medical transportation (NEMT) riders with nationwide driver networks. We operate an app-based dispatch ecosystem integrating healthcare providers, brokers, and independent operators. Role Overview: We are seeking an experienced Regulatory & Healthcare Transportation Attorney to lead our multi-state expansion, state permitting, and operational compliance framework. This role will oversee legal risk management spanning TNC transportation laws, Medicaid regulations, HIPAA compliance, and independent workforce structuring. Key Responsibilities: Multi-State Transportation & Regulatory Compliance - Research state-by-state requirements for NEMT, TNC, livery, and transportation operations. - Determine required licenses, permits, registrations, and operating authority. - Assist with PUC/CPUC, DOT, Department of Health, and other regulatory requirements. - Develop a state-by-state regulatory roadmap for expansion. Healthcare & Medicaid Compliance - Advise on Medicaid/NEMT requirements and healthcare provider relationships. - Advise on HIPAA/HITECH, NPI-related requirements, BAAs, and healthcare data protection. - Review healthcare and NEMT broker agreements. - Assist with Fraud, Waste & Abuse (FWA) compliance requirements. Independent Contractor & Driver Compliance - Draft/review 1099 Independent Contractor Agreements and transportation-provider agreements. - Advise on worker classification and state-specific requirements, including California AB5. - Review driver onboarding, credentialing, background checks, vehicle, and insurance requirements. Technology & Commercial Agreements - Review/draft app Terms of Service, Privacy Policies, Driver Agreements, Provider Agreements, BAAs, vendor agreements, and commercial contracts. - Advise on liability, indemnification, privacy, compliance, and contractual risk. Insurance & Risk Management - Help identify the appropriate insurance coverage for our NEMT/TNC platform. - Work directly with commercial insurance brokers/carriers to help us obtain and secure appropriate coverage. - Help evaluate Commercial Auto, TNC Master Auto, General Liability, Professional Liability/E&O, Cyber Liability, Umbrella/Excess, and other applicable coverage. - Review insurance proposals, policies, exclusions, COIs, and contractual insurance requirements. - Ensure coverage meets applicable state regulations and requirements from healthcare organizations, NEMT brokers, and government/commercial contracts. - Help establish insurance requirements for transportation providers and independent drivers. Required Qualifications: - J.D. from an accredited U.S. law school. - Active U.S. state bar admission in good standing. - 5+ years of relevant legal experience. - Strong experience in healthcare regulatory, transportation/TNC, NEMT, HealthTech, or related areas. - Experience with multi-state regulatory research and licensing. - Strong understanding of HIPAA/HITECH and independent contractor/1099 laws. - Excellent legal research, drafting, and communication skills. Highly Preferred: - Direct NEMT or medical transportation experience. - TNC/rideshare or app-based transportation experience. - Medicaid/NEMT regulatory experience. - PUC/CPUC experience. - California AB5 experience. - Commercial transportation insurance experience. - Experience working directly with insurance brokers/carriers. - VA, government healthcare, or government transportation contract experience.
