Summary

I run a recruitment operation that places Mexican construction tradespeople with Spanish employers facing labor shortages. I have a sourcing partner in Mexico and am building out the Spain side. I need a Mexican lawyer to ensure the Mexican side of recruiting and sending workers abroad is fully compliant with Mexican labor law and properly protects the workers. What I need help with Advising on and ensuring compliance with the rules for recruiting Mexican workers for employment abroad — the Ley Federal del Trabajo (Articles 28 and 28-B) and the Reglamento de Agencias de Colocación de Trabajadores. Handling the required authorization/registration of the recruitment/placement activity with the STPS (Secretaría del Trabajo y Previsión Social) / Servicio Nacional de Empleo for a private agency placing workers abroad. Ethical-recruitment compliance: services free to the worker (no fees ever charged to candidates), truthful disclosure of job conditions, worker information on consular protection, non-discrimination, and the prohibition on placing minors — so we have zero trafficking or abuse exposure. Drafting/reviewing candidate-facing documents: consents, service agreements, and personal-data handling compliant with Mexico's data-protection law (LFPDPPP). Advising on and coordinating candidates' document legalization (federal criminal-record certificate, apostille via SEGOB, birth certificates) so files are valid for the Spanish consulate. Advising whether and how to form a Mexican entity for the sourcing operation, and structuring it correctly. Flagging any obligations that fall on the placement agency under Mexican law (e.g., repatriation responsibility). Required Licensed Mexican lawyer (cédula profesional), specializing in labor law (derecho laboral) and/or migration. Demonstrated knowledge of LFT Articles 28/28-B, the Reglamento de Agencias de Colocación de Trabajadores, and STPS registration for recruiting workers for jobs abroad. Experience with labor migration / sending Mexican workers abroad (e.g., H-2 programs, Canada's seasonal program, or similar) strongly preferred. Strong written and spoken English; native Spanish. Nice to have Experience in the staffing/recruitment world, or a network of useful contacts in it (recruiters, placement agencies, employer associations) — I value practical industry advice and, where appropriate, introductions, not just the legal filings. Data-protection (LFPDPPP) experience. Corporate/company-formation experience in Mexico. Experience coordinating apostilles and document legalization. Engagement Fully remote. I'd like to begin with a paid initial consultation to map out the compliance and registration requirements, then move to a per-file or retainer arrangement as placements begin.
