Montana Tenant Recovery & Claims Filing (Per Case Basis)

Project Overview We are seeking a detail-oriented, legally minded independent contractor with experience interpreting and applying Montana landlord-tenant laws to assist our property management and ownership team on a per-case basis. The ideal candidate will help evaluate, document, prepare, and pursue claims against former tenants who have abandoned rental properties, violated lease agreements, caused excessive property damage, failed to pay rent, or otherwise left significant financial liabilities behind. This is not a traditional legal attorney role. We are seeking a highly organized professional who understands landlord-tenant regulations, documentation requirements, evidence compilation, demand letter preparation, collections processes, court filing preparation, and recovery strategies within Montana's legal framework. For perspective purposes, with the existing documents, templates, and familiarity with process and procedural timelines, 4 to 5 of these start to finish can be processed per month. Translating into 1-2 hours per day and potentially $1000 per month. Typical Case Scenarios Cases may involve one or more of the following: - Tenant abandonment - Unpaid rent and lease obligations - Excessive property damage beyond normal wear and tear - Pest infestations caused by tenant neglect - Unauthorized occupants or pets - Property contamination requiring remediation - Utility balances and chargebacks - Cleaning and restoration expenses - Costs associated with making units rentable again - Lost rental income resulting from extended vacancy - Lease violations resulting in financial damages - Collection of judgments and post-judgment recovery efforts Responsibilities The selected contractor may be asked to: - Review leases, move-out documentation, inspection reports, photos, invoices, and resident ledgers - Analyze claims under Montana landlord-tenant statutes and applicable regulations - Organize evidence and develop case files - Calculate damages and recoverable amounts - Prepare demand letters and supporting documentation - Assist with small claims or district court filing preparation - Research collection options and recovery strategies - Track deadlines, notice requirements, and procedural compliance - Communicate professionally with ownership, management, vendors, and outside legal counsel when necessary - Identify strengths, weaknesses, and expected recovery potential for each claim - Recommend the most cost-effective path forward for recovery Desired Qualifications - Strong understanding of Montana landlord-tenant law - Experience working with property management companies, landlords, collections agencies, legal offices, or real estate operations - Excellent research and documentation skills - Ability to independently manage cases from intake through resolution support - Familiarity with court procedures, civil claims, judgments, and collections processes - Strong written communication skills - High attention to detail and evidence organization Deliverables Depending on the case, deliverables may include: - Case summary and recovery assessment - Evidence and documentation package - Damage calculation worksheet - Demand letters - Filing-ready court documentation - Collection recommendations - Recovery action plan and status updates Compensation - Paid on a per-case or project basis - Potential for recurring work with a growing portfolio of claims - Compensation will vary based on complexity, documentation volume, and expected scope of work About Us We own and operate mobile home rentals and mobile home communities. Our objective is to recover losses caused by tenants who leave properties in a condition that requires substantial rehabilitation before re-leasing. These situations often result in significant direct expenses, lost income, administrative burden, and diversion of resources away from routine property operations and resident service.
