# Paralegal / Legal Research Specialist Needed for Startup Regulatory Research We are looking for an experienced **Paralegal, Legal Researcher, or Regulatory Research Specialist** to conduct comprehensive legal and regulatory research for an innovative startup business model. This is a **research-focused role**. We are seeking someone who can identify applicable laws, regulations, legal risks, and compliance considerations and present the findings in a clear, well-organized report. Experience working with attorneys, startups, healthcare, consumer platforms, or cross-border regulatory matters is a strong plus. ## Scope of Research The selected freelancer will review our business model and publicly available materials and conduct research covering the following jurisdictions: * United States * European Union * India The research should include both general legal analysis and, where appropriate, more detailed **jurisdiction-specific considerations**. ## Key Areas to Assess ### 1. Business Model Review * Review and understand the client's business model. * Review relevant publicly available materials, websites, terms, policies, and comparable business models where useful. * Identify the primary legal and regulatory issues associated with the model. ### 2. Consumer Protection Research applicable issues relating to: * Consumer protection laws * Unfair or deceptive practices * Consumer disclosures * Terms of service and user agreements * Refund, cancellation, and payment-related considerations * Privacy and transparency requirements where relevant ### 3. Platform Liability Assess potential liability risks for an online platform, including: * Liability arising from interactions or transactions facilitated through the platform * Responsibility for third-party providers or users * Platform terms, disclaimers, and limitations of liability * Potential intermediary or marketplace liability issues * Cross-border platform operations ### 4. Independent Contractor and Employment Classification Research legal considerations related to hiring and working with independent contractors, including: * Independent contractor vs. employee classification risks * How the company should structure contractor relationships * Relevant worker classification tests in applicable jurisdictions * Potential wage, tax, benefits, and employment-law consequences * Recommendations for reducing misclassification risk ### 5. HSA and FSA Considerations Include research regarding potential **HSA (Health Savings Account) and FSA (Flexible Spending Account)** implications, including: * Whether the proposed products or services may potentially qualify for HSA/FSA payment or reimbursement * Relevant eligibility and substantiation considerations * Consumer communications and marketing risks related to HSA/FSA claims * Any relevant IRS, benefits, healthcare, or regulatory considerations * Key limitations, risks, and areas requiring attorney or tax-professional review ### 6. Advertising and Marketing Compliance Assess risks relating to: * Advertising and marketing claims * Misleading or deceptive advertising * Required disclosures * Influencer, testimonial, or endorsement rules, if applicable * Marketing of healthcare, wellness, or HSA/FSA-related services, if applicable * Jurisdiction-specific advertising restrictions ### 7. Cross-Border Operations Analyze key considerations for operating across the United States, European Union, and India, including: * Differences in applicable regulatory frameworks * Cross-border service delivery * Consumer contracting considerations * Data, payment, tax, or operational issues where relevant * Key jurisdiction-specific risks that could affect expansion ## Deliverables We expect a clear written research report that includes: 1. **Executive Summary** * Key findings * Major legal and regulatory concerns * Most significant recommended actions 2. **Business Model and Legal Issue Overview** * Summary of the business model reviewed * Key legal questions identified 3. **Jurisdiction-Specific Analysis** * United States * European Union * India 4. **Risk Assessment** Each identified issue should be prioritized as: * **High Risk** * **Medium Risk** * **Low Risk** 5. **Potential Legal Consequences** Provide a high-level overview of potential consequences, such as: * Regulatory enforcement * Civil liability * Fines or penalties * Consumer claims * Employment-related exposure * Business or operational restrictions 6. **Practical Recommendations** Provide high-level, practical recommendations for reducing identified legal and regulatory exposure. 7. **Source Documentation** Include links or citations to relevant laws, regulations, government guidance, regulatory authorities, and other reliable sources used in the research. ## Ideal Candidate We are looking for someone with experience in one or more of the following: * Paralegal or legal research * Regulatory research * Startup and technology law * Consumer protection * Online platforms or marketplaces * Employment and independent contractor classification * Healthcare or benefits-related regulations * HSA/FSA research * Advertising and marketing compliance * U.S., EU, and/or India legal research * Cross-border legal and regulatory research **Important:** This engagement is primarily for legal and regulatory research and a structured risk assessment. We may separately engage qualified legal counsel to review conclusions and provide formal legal advice.
