Spain-Qualified IP Lawyer — Consultation on Trademark Infringement Enforcement Process

SMB Legal Counsel, a U.S. law firm, seeks a Spain-qualified IP/trademark attorney for a one-time CONSULTATION (attorney-to-attorney). We need to understand the trademark-infringement ENFORCEMENT process in Spain so we can advise our client on whether and how to move forward if it identifies someone infringing its mark in Spain/the EU. This is a consultation, not representation. We want a practical walkthrough of the process and realistic expectations. TOPICS TO COVER - Enforcement options and the typical sequence: cease-and-desist, negotiated resolution, customs/border measures, civil action, and any criminal route. - Where actions are brought (Spanish commercial courts / EU trademark courts) and whether an EUTM vs. a Spanish national registration changes the path. - Preliminary/interim injunctions: availability, the standard to obtain one, and how quickly relief is realistic. - Remedies (injunction, damages, account of profits, destruction, publication) and what is realistically achievable. - Evidence and pre-action steps needed to position a strong case. - Typical timeline and ballpark cost ranges for each stage. - Whether local counsel/representation is required and how a U.S. firm typically coordinates with Spanish counsel. FORMAT / DELIVERABLE - A live consultation call (approx. 60 minutes), plus - A short written summary (1-2 pages) of the process and recommended next steps we can use internally. REQUIREMENTS - Qualified and currently admitted to practice law in Spain (please state your bar/colegio). - Active trademark/IP enforcement and litigation experience in Spain/EU. - Comfortable advising attorney-to-attorney in English.
