California Employment Attorney (Employer Side) – Flat Fee Preferred We are a small California business with approximately 4–5 employees seeking an experienced California employment attorney (or U.S. attorney with significant California employment law experience) to assist with a complex employment matter. We are looking for practical, business-oriented legal advice and hope to establish a long-term relationship with the right attorney for future employment matters. Background The matter involves an employee who worked for our company for approximately seven weeks. During that time, documented performance issues, misconduct, policy violations, disciplinary action, and other workplace concerns arose. The situation has caused significant disruption to our business operations, impacted other employees, consumed substantial management time, and resulted in financial loss to the business. The employee is currently on an accepted workers’ compensation leave following a workplace injury and remains on medical leave. Since going on leave, the employee has continued sending hostile and threatening communications, including threats of legal action, and has continued contacting other employees regarding employment-related matters despite being on leave. We have prepared a detailed chronology together with supporting emails, text messages, disciplinary documentation, and other relevant evidence. Our objective is to end the employment relationship in a legally compliant and well-documented manner while minimizing legal risk. Any employment decision would be based solely on legitimate, documented business reasons that are independent of the workers’ compensation claim or medical leave. Scope of Work (Flat Fee Preferred) We are seeking a fixed-fee proposal for: * Reviewing our chronology and key supporting documentation. * Assessing our legal position and identifying any significant risks. * Advising whether termination is appropriate and the safest timing under California law. * Drafting a legally appropriate termination letter tailored to the circumstances. * Advising on any recommended steps before and after termination to help protect the business, including final pay requirements, company property, communications, and any other important legal considerations. * Advising whether a cease-and-desist letter or other protective measures would be appropriate in response to the ongoing hostile communications and threats. Future Work If we are a good fit, we would like to continue working with the same attorney for future employment matters and, if necessary, representation in responding to any claims, administrative proceedings, or litigation.
