Summary

We’re a New York physician search and placement firm seeking regulatory counsel with hands-on experience in New York employment agency licensing (General Business Law Article 11 / NY Department of Labor). This is regulatory and licensing work, not employment litigation. We are not looking for discrimination, wage-and-hour, or termination counsel, and not corporate formation. Background: We currently hold a NY DOL employment agency license and have a Manager of Record on file. We place physicians on a permanent basis. Our fee model is employer-pays, and the candidate is never charged, directly or indirectly. What we need: 1. A written opinion on whether our model still requires the employment agency license or fits a different regulatory category under Article 11. 2. A clear explanation of the continuing obligations that apply either way, so we understand what actually changes and what does not. 3. Analysis of whether our placement and fee agreements remain enforceable under that conclusion. Same lawyer, same engagement, addressed together with the licensing question. 4. If anything changes, a sequenced action plan. We will not surrender the license or unwind the Manager of Record arrangement until counsel confirms the path. We want the opinion first and the decisions after. We want your independent read, not confirmation of a conclusion we have already reached. Deliverable: a written legal opinion we can rely on. Please answer directly in your proposal: • Have you advised staffing or executive search firms on New York employment agency licensing and fee rules? • Have you handled surrendering or modifying a New York DOL employment agency license? If you have not done both, we are likely not the right fit. Please include anonymized matter examples, your approach to the analysis, your New York bar admission and good standing, your hourly rate, and your availability.
