Expert Agency Needed for Social Commerce Mobile & Web App Development
I strongly advise against hiring this agency for time-sensitive or compliance-critical projects. Despite holding a Top Rated Plus badge, a 99% Job Success Score, and reporting over $20M USD in earnings on Upwork, they failed to meet basic delivery and communication standards throughout our engagement.
** Key issues encountered:
1. Missed delivery timelines: Multiple milestones were delayed despite my repeated concerns, significantly impacting the project’s launch schedule and downstream dependencies.
2. Inaccessible files: Several deliverables were submitted in formats that I could not open, utilize, or that differed from the originally agreed specifications. Some files were password-protected without providing the password, and the agency did not offer alternative formats or technical support to resolve the issue, despite my repeated requests.
3. Withheld deliverables: Several key deliverables, clearly specified in the scope of work and milestone agreements, were never provided. Despite multiple requests, the agency refused to refund these undelivered items, constituting a breach of contractual obligations.
4. Unverified weather delays: Although the agency initially confirmed full-time commitment to the project, they later admitted to not working full-time due to alleged weather conditions. However, no such weather alerts were reported by the official meteorological authority in their region during the stated period.
5. Unauthorized payment request: Toward the end of the contract, the agency submitted a change request list totaling $6,000 USD. They claimed I had added extra design work, which is inaccurate. The signed contract clearly stated they would continue designing screens based on the agreed features within the scope of work. Their attempt to reframe this as additional work and demand payment was a direct contradiction of our agreement.
6. Misuse of Upwork systems: The agency attempted to restructure the engagement outside of the agreed signed contract and scope of work, bypassing proper approval and documentation.
** Policy violations: These actions violate Upwork’s Terms of Service, including:
--- (Section 2.1) : User Agreement Failure to deliver agreed-upon work and meet contractual obligations.
Upwork TOS (Sections 2.1 & 2.2) for (Fixed Price Contracts) : Payment is tied to milestones, and freelancers/agencies may not demand additional payment outside of agreed milestones unless the client explicitly funds new ones.
--- (Section 2.3) : Prohibited Conduct Withholding deliverables and submitting unauthorized financial requests.
Upwork TOS (Section 2.3) for (Fixed Price Escrow Instructions) : Freelancers must only perform work within the funded milestone scope unless new milestones are agreed.
--- (Section 7) : Non-Circumvention Attempting to circumvent Upwork’s milestone and payment structure.
