Summary

I'm a California-based, full-time employee seeking a consultation with a California-licensed attorney regarding an employee invention assignment question under California Labor Code §2870. My employment agreement contains a broad invention-assignment clause covering inventions that "relate to the employer's business or anticipated R&D," with the standard §2870 carve-out. On my own time and on personal devices, I've developed a separate digital-health software product. My two core questions: 1. Whether my employer could claim ownership of my project under that clause - specifically the §2870 "relatedness" exception, given my role and my employer's field. 2. What I should and shouldn't do before filing any IP (trademark/patent) in my own name. This is fundamentally a California employment-law question with an IP overlay — not a straightforward trademark filing. I'm looking for someone who advises on employee invention-assignment matters specifically. Required - please confirm in your proposal: - Active California bar license (state your bar number or confirm it's available on request) - Direct experience with employee invention-assignment / Labor Code §2870 ownership questions - Ability to review an 8-page employment agreement and a short prep document ahead of the consultation Two screening questions - please answer briefly in your proposal: 1. In one or two sentences: how does the §2870 "relatedness" exception interact with an employer's "anticipated R&D"? 2. My employer is a large medical-device company. Do you or your firm have any current or past representation of medical-device manufacturers that could create a conflict in a matter adverse to such an employer? I'll name the company privately once you confirm you can take this on. Scope and format: A flat-fee initial consultation, roughly 30 –60 minutes via video or phone, including a review of my agreement and prep document beforehand, so the session is spent on analysis. Please quote your fee (I've set an anchor, but confirm what's included). Open to separate follow-on work (e.g., trademark filing) if it's a good fit, but this engagement is scoped to the consultation only. I have a prep document and the agreement ready to share once you've confirmed California licensure and no conflict.
