Summary

I am currently included as a derivative spouse in my husband’s pending asylum case, but my divorce may be finalized soon\. I also understand that there may be a prior removal order under my A\-number\. Please take the following actions immediately: 1. Confirm in writing whether you currently represent me individually, not only my husband\. 2. Confirm whether I am listed as a derivative spouse on my husband’s Form I\-589\. 3. Obtain and review my complete immigration court and BIA records under my A\-number\. 4. Confirm whether I have a final removal order and whether any appeal, stay of removal, motion, or other proceeding is currently pending\. 5. Explain what will happen to my immigration status and C08 employment authorization when the divorce becomes final\. 6. Determine whether my case must be separated from my husband’s case\. 7. Prepare and file my own Form I\-589, if appropriate, based on the loss of my derivative status due to divorce and the changed\-circumstances exception to the one\-year filing deadline\. 8. Determine whether a motion to reopen, motion to remand, or another filing is required because of my prior removal order or pending appeal\. 9. Advise me whether any filing should be completed before the divorce becomes final\. 10. Review whether I may qualify for any independent relief, including a U visa, VAWA\-related relief, withholding of removal, or protection under the Convention Against Torture\. Please do not withdraw me from, separate me from, or make any changes to the existing asylum case without notifying me in writing and explaining the consequences\. Because my divorce may be finalized soon, this matter is urgent\. Please provide copies of all documents filed under my name and A\-number, including the I\-589, immigration judge’s orders, BIA filings and decisions, notices, and proof of filing\. Please confirm what immediate action you will take to protect my case\. Thank you,
