Summary

Overview We are looking for an experienced, U.S.-based Labor and Employment Law Subject Matter Expert (SME) with deep, practical knowledge of U.S. labor and employment law to help us evaluate and enhance an existing 40-question pre-hire assessment designed to measure candidates' knowledge and skills in this area. You will work closely with our in-house Content Specialist to review every item in the question bank, identify gaps, and help us build two polished, job-relevant assessment blueprints. We value open communication, regular check-ins, and a collaborative approach to quality. ________________________________________ What You'll Be Doing Your core responsibility is to go through our existing question bank and evaluate each item against the following criteria: • Are questions technically sound and clearly worded? • Is the language accurate and appropriate for the target audience? • Is there a need for linguistic simplification to adjust questions for candidates newer to the field or for a younger audience? • Do questions reflect real-world labor and employment law tasks and U.S. industry standards? • Is the technical vocabulary used correctly throughout? • Are answer choices and distractors well-constructed and appropriately challenging? • Is the difficulty level suitable, particularly for candidates entering the profession? ________________________________________ Project Phases 1. High-level subject review & structure Map out the key subject areas a comprehensive Labor and Employment Law (General) assessment should cover. Develop a short definition and topic outline describing what Labor and Employment Law skills encompass and which key abilities should be assessed to confirm professional competence in this domain. Review the existing question bank, identify any coverage gaps or missing topics, and flag questions that are outdated, ambiguous, or technically flawed. Propose structural and content improvements. Review and correct the first 10 questions using the provided template. 2. Detailed question bank analysis Conduct a thorough review of every question (using the provided template): • correct linguistic, factual, or technical inaccuracies, • identify outdated, unclear, or incorrect questions and rewrite them, • recommend removals where necessary, • suggest visual elements where they would improve understanding, • and ensure all content aligns with current U.S. federal and state labor and employment law, including applicable agency guidance (EEOC, DOL, NLRB, OSHA) and relevant statutory frameworks. 3. Optional additional milestone (paid separately) If gaps are identified, you may be asked to draft new questions for underrepresented topics and strengthen sections that lack sufficient coverage. 4. Final adjustments & two assessment blueprints Using our two Test Blueprint templates, select final sets of 40 questions — drawn from both existing and newly created items — to serve as the two completed assessments. Planned project duration: 3–4 weeks. ________________________________________ Who We're Looking For Required • Currently residing & working in the U.S. • J.D. from an ABA-accredited law school and active bar admission in at least one U.S. state • 5+ years of hands-on practice in labor and employment law, with a focus on general employment matters (hiring, termination, discrimination, leave, wage & hour, workplace compliance) • Strong knowledge of federal employment statutes, including Title VII, ADA, ADEA, FMLA, FLSA, NLRA, and OSHA • Familiarity with EEOC enforcement guidance, DOL regulations, and applicable state-level employment laws • Previous involvement in creating exams, assessments, or question banks • Excellent written English Preferred • Management-side employment law experience (advising employers on compliance and HR practices) • Prior experience reviewing or creating assessments or test items • Experience in legal education, professional certification programs, or workforce training • Familiarity with pre-employment screening law, including FCRA, ban-the-box statutes, and EEOC guidance on selection procedures • Knowledge of ADA pre-offer/post-offer inquiry rules and adverse impact analysis Bonus • Background in assessment or test design • Membership in ABA Section of Labor and Employment Law or NELA • Experience working with apprenticeship or workforce development programs • Familiarity with OFCCP compliance and federal contractor obligations ________________________________________ Tools The expert is expected to use provided templates. Proficiency with MS Word and MS Excel is required. ________________________________________ Cooperation Model Work will be conducted in close, ongoing collaboration with the Content Specialist. Regular consultations and feedback rounds are expected throughout all stages of the project. ________________________________________ Before You Begin Upon signing the contract, you will be asked to complete a Non-Disclosure Agreement (NDA) and our Ethical AI Use Guidelines. ________________________________________ How to Apply We're looking for someone who brings both legal expertise and a genuine interest in education. In your proposal, please tell us about your experience as a labor and employment law practitioner and any involvement you've had in legal training, professional licensing programs, or work with industry certification standards. Please also highlight your specific experience advising employers on hiring practices, pre-employment compliance, and general employment law matters.
