This Applicant Privacy Addendum (Canada) (“Canadian Applicant Addendum”) is an attachment to the Global Job Applicant Privacy Notice (“Applicant Privacy Notice”) and applies to individuals permanently residing in Canada. Where this Canadian Applicant Addendum conflicts with the Applicant Privacy Notice, this Canadian Applicant Addendum governs with respect to Canadian individuals.
The Applicant Privacy Notice explains what personal information we collect and how we use and share it. Please refer to the Applicant Privacy Notice for that and other relevant information.
In accordance with applicable Canadian privacy laws, Upwork may collect, use, or disclose applicants’ personal information for the purposes described in the Applicant Privacy Notice without consent where permitted or required by law. Where consent is required by law, Upwork will obtain consent from the applicant.
Upwork may disclose personal information to service providers, contractors, and affiliated entities for the purposes described in the Applicant Privacy Notice, subject to contractual and other safeguards consistent with industry standards and applicable Canadian privacy laws.
Personal information of Canadian individuals may be transferred to, stored in, or otherwise processed in jurisdictions outside Canada, including the United States, and may be subject to the laws of those jurisdictions. Upwork will use appropriate legal transfer mechanisms, including Standard Contractual Clauses, where required by law.

Upwork has designated the Privacy Legal team lead as the individual responsible for compliance with Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”). Canadian individuals may raise questions or concerns about Upwork’s handling of personal information by contacting the Upwork as outlined above. Individuals also have the right to file a complaint with the Office of the Privacy Commissioner of Canada or, where applicable, a provincial privacy authority.
