I paid the defendant $5500.00 in advance for a custom wine cabinet upon contract execution and have supplied additional material worth $1100 for the cabinet till date, with the total value of $6600. At the time of purchase, I was advised that the most likely delivery time frame will be the week of December 17, 2025 and the contractual estimated delivery was agreed to be between December 15-30, 2025. Despite repeated inquiries and request for information/status/calls beginning in late November 2025, they have not communicated in a professional manner and followed design instructions. I have not received the furniture as promised nor a refund has been issued after multiple requests. A Demand Letter was sent to them in late January and they did not comply with the demands (attached). I filed a Small Claim suit in mid-Feb. The defendants were evading service and moving around so I had to file a Substitute Claim with the Secretary of State (in mid-April) and it was accepted A pre-trial conference was schedule for June 18 (after the defendants filed for a continuance of 2 weeks and they also filed a motion for change of venue that I never received but the judge appropriately ruled against it in the conference). This was a moot point since I had requested a remote/Zoom trial and all parties agreed to it in the conference. I was told previously by the clerk that they don't do Zoom trial so the defendants had to travel from St. Petersburg to Vero Beach for this conference. But the judge said that they do in fact conduct Zoom trials so the actual Trial is now set for Aug 12 at 1:30 pm. In this conference, I presented the case to the judge briefly, and the judge suggested arbitration which was not fruitful or efficient and all parties agreed to move forward with the trial. I am looking for professional representation for this trial. I have created a very detailed timeline of events and summary etc. in the Statement of Claim. I have all the receipts and text messages etc. compiled properly that I can provide so hopefully there is not too much effort needed on your part regarding paperwork. The contract is attached.
