Senior Litigation Counsel — Remote, Part-Time Commercial Litigation | Judgment Enforcement | Creditor & Debtor-Side Disputes We are a New York litigation boutique. Commercial litigation, creditor and debtor-side disputes, merchant cash advance defense and restructuring, judgment enforcement, and selected plaintiff-side tort work. Clients work directly with partners. We are looking for one experienced attorney to take work off the partners' desks and actually run it. THE WORK This is execution, not advisory. Across our caseload, that means: Motion practice. Motions to dismiss, summary judgment, discovery motions. A meaningful share of our matters are won or lost on an early, well-aimed motion, and we would rather spend the hours there than in a year of discovery. Discovery. Building and serving demands, responding, meet-and-confers, motion practice to compel, and taking and defending depositions. We favor broad demands narrowed progressively, and discovery aimed where it creates pressure rather than volume. Complex commercial disputes. Contract, business tort, fraud and self-dealing claims, closely held entity disputes, and defense of thinly pled claims brought by better-resourced adversaries. Judgment enforcement. Post-judgment collection against defendants operating through layered entities — marshal levies, bank restraints, information subpoenas, third-party subpoenas, and fraudulent conveyance theories. A growing line where speed and persistence decide outcomes. TROs and preliminary injunctions. Handling applications for emergency injunctive relief in commercial disputes, including temporary restraining orders and preliminary injunction hearings. Creditor disputes and workouts. Defending small and mid-size businesses against aggressive funders and lenders — reconciliation and disguised-loan defenses, UCC Article 9 restraint responses, settlement and forbearance negotiation, and redlining agreements, releases, and confessions of judgment. Restructuring-adjacent work follows: bankruptcy, ABCs, Article 9 sales. Written work product behind partner-led matters. Research memos, case assessments, pleadings, and drafts where a partner is carrying the file but needs the substance built. You would be drafting and arguing motions, running discovery, taking and defending depositions, and where you are admitted and it fits, appearing. Work is reviewed by a supervising partner, but we are hiring judgment, not hands. WHO THIS FITS 15+ years of civil litigation. You have run cases, not just supported them. You can pick up a file well past the pleadings stage and know what to do Monday morning. Semi-retired, of counsel, and independent practitioners strongly encouraged. Comfortable being adversarial. Our clients are usually the smaller party. Opposing counsel is often much better resourced. We do not fold because the letterhead is impressive. Ethically rigid. We are aggressive within the law and facts and nowhere outside them. Nobody here will ask you to be anything else, and we will not work with anyone who wants to be. Curious about better tools. We run Clio, a zero-data-retention Claude business account, and AI-assisted docket review, research, and drafting. Attorneys here have cut large docket reviews from days to an afternoon. You do not need to arrive fluent. You do need to want to learn — this is genuinely how we compete against firms five times our size. No business development. No origination pressure. No minimum hours. You practice. We bring the work. REQUIREMENTS Active bar admission in good standing, any US jurisdiction. NY or NJ a significant plus. Current attorney registration and no disciplinary history; malpractice-insurable. If former government: willingness to complete a post-employment conflicts certification (18 U.S.C. § 207 / RPC 1.11). Comfortable working remotely with Google Workspace and modern practice tools. STRUCTURE 1099 contract engagement, hourly, paid through Upwork initially. 5 to 20 hours per week, scaling with caseload. Some weeks are lighter; some matters run hot. $100 to $200 per hour depending on experience and admission. Contingency participation is available on qualifying enforcement and plaintiff-side matters and is negotiated per matter. Starts as a single defined project so both sides can evaluate fit. We would like this to become a long-term of-counsel relationship.
