I'm an artist and book author. I've published 14 books and sold about 3000 original paintings and many, many thousands of prints. I built my current business from nothing to over a million in sales over a twenty year period, then shut it down for eight years. Eighteen months ago I started it up again. I've done virtually no marketing, but have proven that there is a market for my work -- art and two Substacks on the use of journaling in creative work and in creating a life. I want to experiment on a small initial basis with a variety of PPC advertising: Amazon, Facebook, Google. Separately, an SEO review of my website would probably be helpful. All of these areas don't have to be handled by the same person but the fewer the better. I am so busy painting, writing, designing books, working with a printer, maintaining my website and processing orders that I have limited time for marketing other than in an overall consultation/budget approval sense. I have spent over $100,000 a year on marketing, but that was completely different marketing -- direct mail fifteen years ago. So I understand the value of marketing, and realize that my business needs it. I want to build a long term relationship, years preferably, with a thoughtful, knowledgeable marketing person. Quality, integrity are very important to me. Most of the failed Upwork assignments I've been involved in have failed because the contractor either lacked a sense of quality or integrity, most often both. The quality issues have mostly revolved around not listening, or, more often, agreeing on a plan and then changing it without discussing the change with me first. In other words, doing things not agreed to, or not doing tasks agreed to. I'll need to have two or three zoom conversations before hiring. Next, starting small and putting money behind what's working. I don't have a lot of money to invest in any single initial test, but do have enough money to invest in a lot of little tests. I'm located in the east coast of the US and whomever I work with needs to be available at least some east coast business hours. Rod MacIver Heron Dance Art Studio

Consultant to provide expert opinion on the legality within the US context of using a translated work as reference context in a keyword based LLM chatbot developed commercial use. Note that the entity developing the chatbot is the excusive licensee of the translation rights and the author/owner of the translation. The LLM output would not use content verbatim in its outputs. I enclose some legal literature as background and the input I get from ChatGPT. It seems that a key consideration here is to determine whether this use would be consider a case of "fair use" under the existing translation rights agreement. Please note that the licensor of the translation rights is in the US and the licensee is in Spain. ============= The expert opinion based on the document would likely consider several key aspects of U.S. copyright law regarding using copyrighted works in training AI: Intermediate Copying and Fair Use: The act of using copyrighted materials (like a translated work) for training an LLM may fall under "intermediate copying." Intermediate copies—copies created temporarily as part of a larger transformative process—have sometimes been permitted under the fair use doctrine if the final product does not retain or reproduce the original expressive elements verbatim. However, fair use defenses in AI training cases have been inconsistent, especially if the use affects the market value or potential licensing market of the copyrighted material Transformative Use: Courts have occasionally ruled that if a use is highly transformative—altering the original purpose of the work significantly—the fair use defense is stronger. Here, if the LLM only uses the translated work as "reference context" without revealing or replicating expressive content, some experts might argue it is more likely to be seen as a transformative, non-communicative use, similar to using thumbnails in a search engine to direct users Safe Harbor for Data Mining and AI: There is a growing argument for a data mining "safe harbor" to clarify copyright law around AI. The document suggests that since data mining involves extracting functional patterns rather than reproducing expression, Congress could consider a safe harbor to protect these uses. Such a safe harbor could provide protection if the LLM does not reveal original, expressive content from the translation Market Impact Considerations: Despite the transformative nature, if the use interferes with the original work's potential licensing market (for example, if a market exists for using the translated text as AI training data), it could undermine a fair use defense. A model explicitly avoiding verbatim reproduction may help mitigate this risk, but the legal landscape remains uncertain without a safe harbor provision In sum, while some experts believe that non-communicative, transformative uses of copyrighted works in AI training may qualify as fair use, the lack of clear legal protection makes this a gray area without an established safe harbor for data mining.
